Commercial Lending Support Agreement

Congratulations on your decision to buy or refinance a commercial property. We are glad that you have chosen to work with our company Bay Area Capital Funding, Inc. We offer full support and we are available 7 days a week. We will provide a full analysis of your situation and your prospective purchase, as well as work with prospective lenders and coordinate your transaction with Realtors and title companies. You should feel free to contact us at any time if you feel that we can be of service.

We ask only one favor in return. Since we will be investing what could be a tremendous amount of time in providing the support that you need to make intelligent and informed decisions (see above), we would like a mutual understanding that you will close your loan with us.

Unlike banks, we receive no compensation other than commission. We earn no commission unless your loan closes with us. As a small company with limited resources, we cannot afford to work for free.

We are asking for your acknowledgement below that you agree to close the loan with us. If you find a rate that is better than ours, you agree to give us the chance to match it. If you find fees that are lower than ours, you agree to let us match it. You agree to provide for us written verification of any competitive offers to assist us for this purpose (e.g. a Mortgage Loan Disclosure Statement or Good Faith Estimate). If we can match it, you agree to close the loan with us. If we cannot match it, then you will have the chance to make a decision to stay with us (or cancel with us) and move your loan to another lender, with no further obligation to us.

If however you work with us, and then cancel the loan with us for no documentable reason, you agree to pay us for time and materials spent assisting you with this process, at a rate of $200.00 per hour, with a minimum charge of $500.00 and a maximum charge of $1,000.00 per transaction. You also agree to reimburse us for any hard expenses (credit and appraisal typically) that we have made on your behalf. You agree to pay us by check for these expenses outside of escrow or at close of escrow upon demand.

There is no obligation to us of course if you chose to not complete the transaction.
